The Medicines and Related Substances Control Amendment Act 94 of 1991 intends:
- to amend the Medicines and Related Substances Control Act, 1965, so as
- to delete certain definitions and to define or further define certain expressions;
- to further regulate the powers, functions and constitution of the Medicines Control Council;
- to do away with the disqualification that a member of the council may not have an interest in the sale of any medicine;
- to abolish the Medicines Control Appeal Board;
- to remove legal uncertainty regarding the sale of unregistered medicine by medical practitioners, veterinarians, pharmacists, practitioners and dentists;
- to regulate the control of the sale of medicines and Scheduled substances differently;
- to authorize the council to disclose certain information regarding medicines, Scheduled substances and medical devices;
- to make new provision for appeals against decisions of the council;
- to increase penalties;
- to further regulate the preservation of secrecy;
- to provide for the delegation of the powers of the Minister of National Health in terms of the said Act;
- to extend the power to make regulations;
- to provide for a prohibition on the manufacture, sale or use of certain veterinary medicines;
- to provide for the registration and control of medical devices;
- to delete certain outdated references;
- to repeal the Schedules to the said Act; and
- to make certain adjustments to certain other laws in consequence of the amendments to the said Act; and
- to provide for incidental matters.
