The Patents Amendment Act 58 of 2002 intends:
- to amend the Patents Act, 1978, so as:
- to bring certain provisions in line with the Agreement on Trade-related Aspects of Intellectual Property Rights;
- to bring provisions regarding the processing and amendment of applications under the Patent Co-operation Treaty in line with other applications;
- to effect technical corrections to some provisions and clarify others;
- to provide for the non-infringement of a patent under certain circumstances; and
- to provide for matters incidental thereto.
