According to the South African Schools Act, corporal punishment is against the law. Despite knowledge of this, there are some educators who act independently from the law and still insist on practicing this unacceptable practice. Recently the department lost an appeal, with costs, against a learner who suffered an eye injury as a result of corporal punishment.
As a department we respect the court ruling and we are not intending to challenge it. However, we would like to send a stern warning against those among us who still practice corporal punishment. As a department we view it as serious defiance and a serious offence that can lead to termination of employment. Where there are financial implications, the offenders must be prepared to reimburse the department.
Educators who are still involved in this practice are warned to refrain from doing so. The department views this matter in a very seriously light. Due disciplinary measures would be instituted against offenders that break the law.
