Sea-shore Amendment Act, 1963 (No. 2 of 1963)

to amend the Sea-shore Act, 1935.

Be it enacted by the State President, the Senate and the House of Assembly of the Republic of South Africa, as follows:-

Amendment of section 1 of Act 21 of 1935, as substituted by section 1 of Act 60 of 1959.

1. Section one of the Sea-shore Act, 1935 (hereinafter referred to as the principal Act), is hereby amended-

(a) by the deletion in the definition of "local authority" of the word "and" where it occurs for the fourth time; and (b) by the addition at the end of that definition of the words "and the National Parks Board of Trustees established under the National Parks Act, 1962 (Act No. 42 of 1962)".

Amendment of section 10 of Act 21 of 1935, as amended by section 10 of Act No. 60 of 1959.

2. Section ten of the principal Act is hereby amended-

(a) by the deletion in sub-section (6) of all the words after the expression "sub-section (1)"; and

(b) by the addition of the following sub-section:
"(7) Any regulation made under sub-section (1) or (6) in regard to any portion of the sea-shore situated within or adjoining the area of jurisdiction of a local authority, may with the approval of the Administrator of the province in which such area of jurisdiction is situated, mutatis mutandis be applied also on land owned by that local authority and abutting on such portion of the sea-shore.".

Short title.

3. This Act shall be called the Sea-shore Amendment Act, 1963.
