Road Transportation Amendment Act, 1982 (No. 78 of 1982)

Act

  • to amend the Road Transportation Act, 1977, so as
    • to further define the expression "decentralized industry"; with regard to the conveyance by a decentralized industry of its own goods; and
    • to provide for the making of regulations concerning the conveyance of exempted goods; and
  • for matters connected therewith.

BE IT ENACTED by the State President and the House of Assembly of the Republic of South Africa, as follows:-

Amendment of section 1 of Act 74 of 1977m as amended by section 1 of Act 93 of 1979, section 1 of Act 91 of 1980 and section 1 of Act 64 of 1981.

1. Section 1 of the Road Transportation Act, 1977, is hereby amended-

(a) by the substitution in subsection (1) for paragraph (a) of the definition of "decentralized industry" of the following paragraph:

"(a) receives or has received decentralization benefits or assistance from the Department of Industries, Commerce and Tourism and which is situated within an area declared to be a decentralized industrial area under section 2 (c) and which prior to such declaration [-

(i) was situated elsewhere and had been transferred thereto; or

(ii)] was established in that area [under any scheme of expansion of an undertaking which is not situated in that area]; or";

(b) by the substitution for paragraph (v) of subsection (2) of the following paragraph:

"(v) the conveyance in the manner and on the conditions prescribed by regulation by a decentralized industry in the course of its business of its own goods by means of one goods vehicle only (except a trailer) the [carrying capacity] gross vehicle mass of which does not exceed [eight] twenty-six thousand kilograms or by means of one trailer only the gross vehicle mass of which does not exceed eighteen thousand one hundred kilograms and of which the decentralized industry is the owner, provided such goods vehicle or trailer, as the case may be, is registered and identified in the manner prescribed by regulation;";

(c) by the substitution in paragraph (z) of subsection (2) 35 for the words preceding subparagraph (i) of the following words:

"the conveyance in the manner and on the conditions prescribed by regulation of exempted goods, by means of a motor vehicle-".

Short title.

2. This Act shall be called the Road Transportation Amendment Act, 1982.
