Act
- to amend the Indians Education Act, 1965, so as to further regulate the power of college councils relating to statutes; and
- to provide for matters connected therewith.

BE IT ENACTED by the State President and the House of Delegates of the Republic of South Africa, as follows:-
Amendment of section 3A of Act 61 of 1965, as inserted by section 3 of Act 78 of 1984.
1. Section 3A of the Indians Education Act, 1965, is hereby amended by the substitution for subsection (2) of the following subsection:
"(2) (a) A college council [established for a college of education] may [name statutes] frame-
(i) a statute providing for the general government of the college of education or technical college concerned in relation to any matter not specifically prescribed by any law; and
(ii) regulations for the better carrying out of such statute: Provided that-
(aa) a statute or regulation in so far as it relates to the composition of a college senate of a college of education shall not be framed, amended, added to or repealed except after consultation with such college senate;
(bb) a statute or regulation in so far as it relates to the studies, instruction, examinations or discipline of students at a college of education shall not be framed, amended, added to or repealed except after consultation with the college senate of such college of education.
(b) [No statute framed under paragraph (a) shall be in force unless it is approved by the Minister and is published in the Gazette] Any statute or regulation which the college council proposes to frame under paragraph (a) shall be submitted to the Minister for his approval and, if approved by him, shall be published in the Gazette and shall have force and effect on such publication.".
Short title.
2. This Act shall be called the Indians Education Amendment Act, 1985.
