Act

  • to amend the Deeds Registries Act, 1937, so as
    • to provide for the registration of notarial variations and renewals of notarial prospecting contracts; and
    • to facilitate under certain circumstances the obtaining, by a joint holder of a certificate or deed of cession of rights to minerals, of a certificate of rights to minerals in respect of his share in such rights; and
  • to provide for matters connected therewith.

Be it enacted by the State President, the Senate and the House of Assembly of the Republic of South Africa, as follows:-

Amendment of section 3 of Act 47 of 1937, as substituted by section 2 of Act 87 of 1965 and amended by section 1 of Act 41 of 1977 and section 1 of Act 92 of 1978.

1. Section 3 of the Deeds Registries Act, 1937, is hereby amended by the substitution for paragraph (q) of subsection (1) of the followmg paragraph.

"(q) register notarial prospecting contracts and notarial variations, renewals and cessions thereof and cancellations of such contracts;". 

Substitution of section 74 of Act 47 of 1937.

10 2. The following section is hereby substituted for section 74 of the Deeds Registries Act, 1937:

"Undivided share of rights to minerals.

74, The provisions of [sub-section (1) of] section 34 shall mutatis mutandis apply in respect of persons who jointly hold a certificate or deed of cession of rights to minerals.''.

Short title.

3. This Act shall be called the Deeds Registries Amendment Act, 1980.
