Advertising on Roads and Ribbon Development Amendment Act, 1979 (No. 2 of 1979)

Act
- to amend the Advertising on Roads and Ribbon Development Act, 1940, relating to
- the definition of "public road";
- the erection of buildings and other structures near certain roads; and
- the metrication of certain distances; and
- to provide for incidental matters.

Be it enacted by the State President, the Senate and the House of Assembly of the Republic of South Africa, as follows:-
Amendment of section 1 of Act 21 of 1940, as amended by section 11 of Act 22 of 1944, section 1 of Act 28 of 1952, section 1 of Act 16 of 1962 and section 29 of Act 54 of 1971.
1. Section of the Advertising on Roads and Ribbon Development Act, 1940 (hereinafter referred to as the principal Act), is hereby amended-
(a) by the substitution for the definition of "public road" of the following definition:
"'public road' means any road [which the public has the right to use] declared a public road in terms of any law, but does not include a national road as defined in the National Roads Act, 1971;";
(b) by the substitution for the expression "one hundred Cape feet " where it occurs in the definition of "road",of the expression "200 m".
Amendment of section 8 of Act 21 of 1940, as substituted by section 1 of Act 16 of 1966 and amended by section 29 of Act 54 of 1971.
2. Section 8 of the principal Act is hereby amended by the substitution for the expression "two hundred yards" where it occtirs in subsection (1), of the expression "200 m".
Amendment of section 9A of Act 21 of 1940, as inserted by section 2 of Act 6 of 1976.
3. Section 9A of the principal Act is hereby amended by the substitution for paragraph (a) of subsection (1) of the following paragraph:
"(a) on land situated within a distance of 500 m from the intersection of the centre line of-
(i) a building restriction road with the centre line of another building restriction road or any other road;
(ii) any road with the boundary of any building restriction road with which it links up;
except a national road as defined in the National Roads Act, 1971 (Act No. 54 of 1971), erect any structure or any other thing which is attached to the land on which it starids, whether or not it forms part of that land;";'
Amendment of section 11 of Act 21 of 1940, as amended by section 12 of Act 22 of 1944, section 2 of Act 28 of 1952, section 6 of Act 16 of 1962 and section 29 of Act 54 of 1971.
4. Section 11 of the principal Act is hereby amended by the substitution for the expression "three hundred Cape feet" wherever it occurs, of the expression "95 m".
Short title.
5. This Act shall be called the Advertising on Roads and Ribbon Development Amendment Act, 1979.
