Removal of Mr Rubben Mohlaloga as ICASA Councillor and Chairperson

The Minister of Communications, Ms Stella Ndabeni-Abrahams has, in accordance with section 8(3)(b) of the Independent Communications Authority of South Africa Act, No. 13 of 2002 (“ICASA Act”) given effect to the National Assembly resolution and removed Mr Rubben Mohlaloga from office.

On 19 March 2019, the National Assembly (NA)  resolved, in terms of section 8(2)(a) of the ICASA Act to remove Mr Mohlaloga as a Councillor and Chairperson of the Authority with immediate effect.

On 15 March 2019, the Minister acting in line with section 8 (3) of the Act, had suspended Mr Mohlaloga pending conclusion of the NA process to remove him from office following a resolution of the Portfolio Committee on Communications on the matter.

Mr Mohlaloga was convicted of fraud and money laundering on 15 January 2018. On 14th February 2019, the Pretoria Specialised Commercial Crimes Court imposed a sentence of 20 years imprisonment on Mr Mohlaloga. In terms of section 6(1)(j) of the ICASA Act, a Councillor who is convicted of, amongst others, fraud; is disqualified from holding office.

The ICASA Council will, as empowered by section 5 (2)(b) of the Act, elect an Acting Chairperson. Further, the process to appoint a new Chairperson will soon commence.
