Minister Mildred Oliphant designates Advocate Molefe as Registrar of Labour Relations

Advocate Lehlohonolo Daniel Molefe has been designated by Labour Minister, Mildred Oliphant as the new Registrar of Labour Relations.

The designation is made in terms of section 108(1) of the Labour Relations Act (LRA)  and is effective from 15 May 2018. Advocate Molefe has been with the Legal Services Unit of the Department of Labour for a number of years, and is both qualified and experienced in labour law. He replaces Johannes Theodorus Crouse who left the Department for retirement last November after spending 39 years with the Department.

Advocate Molefe is expected to play a leading role working with labour federations, Bargaining and Statutory Councils, the Commission for Conciliation Mediation and Arbitration (CCMA) and NEDLAC among stakeholders.

The objective of his job (Registrar) is to ensure the optimal use of the collective bargaining framework in order to promote co-operative labour relations and economic efficiency and growth. It is also to promote strong unionism and employer organisations and promote the establishment of councils in order to achieve sound and stable labour relations.

The portfolio’s key responsibilities include:

  • Facilitate establishment of bargaining councils/Statutory Councils
  • Register labour organisations
  • Eradicate non-genuine organisations
  • Ensure compliance of labour organisations with legal requirements
  • Deal with court case emanating from any decision of the Registrar

Molefe obtained his Senior Certificate at Mandlenkosi Senior Secondary School. He has a L.L.B degree obtained from University of the Western Cape. He was admitted Advocate of the High Court of South Africa in 2009.

Prior to his latest appointment Molefe has been working as a Senior Administration Officer in the Legal Services Director of the Department of Labour  where he was responsible for advising and ensuring compliance with labour laws, handling litigation on behalf of the Department, dealing with legislative drafting for the department, draft and prepare contract, ensure compliance to various legislation among others.

He joined the Department of Labour in 2006 as an inspector. He rose through the ranks. Between 2007 and 2014 was a Senior Practitioner performing an assortment of duties from attending to litigation and writing instructions to State Attorney to representing the Department of Labour in Tribunals, conducting  investigations in terms of Compensation for Occupational Injuries and Diseases Act, conduct legal research for Department of Labour overseeing the legislating compliance.

Between 2014 and 2016 he was Legal Practioner in Legal Services and was later appointed Senior Legal Practitioner.

Molefe said on his appointment: “the office of the Registrar is open for business”.
