NMW Bill exemptions roadshows come to an end

The curtain on the National Minimum Wage (NMW) roadshows aimed at employers focusing on exemptions came to an end in Stillfontein, North West this week with the Department of labour urging business to familiarise itself with regulations governing the Bill.

Stephen Rathai, director of employment Standards in the department, dwelt at length about section 15 and 16 of the NMW.

Section 15 says an employer or an employers’ organisation acting on behalf of its members may apply for exemption in prescribed for or manner.

On the other hand, section 16 talks about making regulations relating to the form and manner in which exemptions must be made and says:

  • Procedure for applying for an exemption
  • The information to be submitted with application
  • Obligations on employers to consult with employees or trade unions concerned.
  • Criteria that must be followed when evaluating applications
  • Period within which an application must be made and any another matter that must  or may be prescribed in terms of of the Act which the Minister considers necessary or expedient.   

“We are aware that come implementation time of the NMW, some employers may need exemptions or flexibility”, Rathai said

‘’Regulations give you procedures when applying for exemption or distressed’’, he said.

The implementation date for NMW was originally set for May 1 but was postponed to allow for the parliamentary processes to run their course.

The NMW roadshows for employers came hot on the heels of those aimed at labour unions. They provided stakeholders an opportunity to make inputs towards the law.
