Progress on land claims lodged with the Commission on Restitution of Land Rights and implications of the judgement on land claims

The Commission on Restitution of Land Rights has successfully managed to settle 98% of the land claims lodged as at 31 March 2016. The Commission has prioritized the settlement of land claims lodged by the cut-off date of 31 December 1998 for finalisation.

On the 28 July 2016, the Constitutional Court declared that Parliament failed to satisfy its obligation to facilitate public involvement in accordance with section 72(1) (a) of the Constitution. The Restitution of Land Rights Amendment Act 15 of 2014 was declared invalid, effective from the date   of that judgment. The court directed Parliament to remedy the fault within 2 years. This means that new claims cannot be accepted as from 27 July 2016 nor can be processed.

On Wednesday, 8 September the Commission on Restitution of Land Rights will brief Parliament on the implications of the Constitutional Court Judgment on the Restitution of Land Rights Amendment Act.
