Whether Eskom initiated litigation and/or claims against coal suppliers (details furnished); if not, why not; if so, what are the relevant
Reply:
Yes, Eskom has instituted legal action in the form of arbitration proceedings against the relevant parties in respect of the financial prejudice suffered by Eskom. The cause of action relied upon by Eskom is in the main breach of contract, negligent misstatement, unjustified enrichment. A claim has been instituted in the sum of R80 877 425.31.
