South African Police Service (SAPS) Constable facing murder charges denied bail, Mfuleni, Western Cape

Constable Ndlwana, who is based at Delft CID was denied bail on 17 August 2010 by the Bluedowns Magistrates Court. The Independent Complaints Directorate (ICD) is investigating a case of murder against the aforesaid police officer who was off-duty when the incident occured.

It is alleged that on 7 August 2010 at about 02:00am, an off-duty police officer was responding to an attempt by an intruder to gain entry into his house while the family was asleep. The police officer took his firearm to investigate.

He allegedly heard movement in the storeroom attached to his house. He then shouted to the person to come out but there was no response. He went inside the storeroom and the person inside allegedly grabbed his firearm and a struggle ensued resulting in a shot going off. The alleged intruder, Siphamandla Banga, 21, was shot and died on the scene.

ICD investigators attended the scene and on the strength of the evidence uncovered during the investigation, the ICD investigators arrested the Constable. Constable Ndlwana appeared in the Bluedowns Magistrates Court on 17 August 2010. Although, the ICD did not oppose bail, the Magistrate felt that the allegations were quite serious and that it would not be in the interest of justice to grant bail. Therefore, the suspect officer was denied bail. The police officer will remain in custody until the next appearance on 17 November 2010.
