A Captain based at Vosloorus police station, Fanyana Aldrin Sibuyi (39) was today convicted for the murder of a 16-year-old boy, Vusi Zwane.
It is alleged that on 1 January 2009 the police received a complaint of armed robbery in Vosloorus. The police went on a search and found the suspects at Vosloorus stadium. Upon noticing the police, the suspects ran away and a chase ensued which led to the arrest of one suspect. Whilst the other policemen were chasing the other suspect, Captain Sibuyi ran after two school boys who were not connected to the robbery. One boy managed to escape but the deceased, Vusi Zwane was shot and killed whilst raising his hands to surrender.
The Independent Complaints Directorate (ICD) investigated the matter. The case was heard before the South Gauteng High Court and Captain Sibuyi was found guilty of murder. He will appear at the same court tomorrow, 3 December 2010 for sentencing.
In another matter investigated by the ICD, two policemen stationed at Orange Farm SAPS were convicted for assault with intent to cause Grievous Bodily Harm (GBH).
Lieutenant Colonel ME Molotsi who was a Captain at the time of the incident and Constable MA Mthethandaba were found guilty of assaulting an Orange Farm resident on 10 March 2007. It is alleged that there was an altercation between the police and some members of the Orange Farm community that resulted in the assault and later the arrest of the complainant. This was after the members of the community had caught a man who was suspected of house breaking.
The Vereeniging Magistrates Court convicted Lt Col Molotsi and Const Mthethandaba for assault GBH and sentenced them to three months imprisonment, half of which is suspended for three years or a fine of R3 000 each.
