The Department of Defence (DOD) has lodged a request for leave to appeal on 1 December 2010 judgment by Justice Pretorius of the North Gauteng High court. Simultaneously, has brought an application under Rule 42 of the Uniform Rules requesting that the court rescind or vary “an order or judgment in which there is an ambiguity, or a patent error or omission, but only to the extent of such ambiguity, error or omission".
The DoD is confident that the high court or the appellate courts will vindicate its positions in regard to the very important issues of national security and the constitutional obligation to ensure that the "defence force must be structured and managed as a disciplined military force."
This is our non-delegable duty and we intend to carry it out to the fullest extent. We will not countenance a repetition of the disgraceful conduct of the few soldiers who behaved contrary to the Code of Conduct of the South African National Defence Force (SANDF). Instilling strict discipline and weeding out acts of ill-discipline from the ranks of our military is a task that must be done.
