Public Enterprises applies for leave to appeal recent judgment on Mango Airlines

The Department of Public Enterprises (DPE) has applied for leave to appeal the judgment and order that was handed down by the Pretoria High Court earlier last month.

The DPE said the application for leave to appeal was consistent with the legal advice that it has received on the case.

“The intention of this application is to ensure that all aspects of Mango’s business rescue process are transparent, legally sound and in the best interest of the South African public,” the DPE said.

“This is not a stalling tactic or an attempt to undermine the need to bring finality to Mango’s business rescue process,” the DPE added.

On 6 September 2023, the Pretoria High Court had delivered a judgment in which the Minister of Public Enterprises, Mr. Pravin Gordhan was ordered to decide on the sale of Mango as proposed by the BRP within 30 days.

As was previously communicated, Minister Gordhan is still awaiting the following information from the BRP to enable him to make the decision on the PFMA Section 54 (2) application:

  1. Detailed business plan to assess the consortium's viability.
  2. Comprehensive due diligence.
  3. Foreign ownership details to comply with South African laws.
