The Passenger Rail Agency of South Africa (PRASA) is proposing to increase passenger rail fares with effect from April 2012. In terms of the Constitution, rail services are a national competence and the Minister of Transport is the custodian of this mandate.
PRASA is an entity of the Ministry of Transport charged with the responsibility for rail services and, together with its Board of Directors, consults with stakeholders and makes recommendations to the Minister regarding increases in passenger rail fares.
Section 21(1)(d) of the National Land Transport Act, 2009 (Act No. 5 of 2009) provides that the National Public Transport Regulator (NPTR), which will be a division of the Department of Transport, must oversee fares charged for public transport services throughout the country. Although the NPTR has not yet been established as a division, this function rests with the Department of Transport.
PRASA is undertaking a process of consultation and engagement with stake holders and role players regarding proposed increases in passenger rail fares and will make recommendations to the Minister. The Minister has the prerogative to approve the recommendations.
