The Pan South African Language Board (PanSALB) has today taken a decision to dismiss its CEO, Mrs Ntombenhle Nkosi, with immediate effect after a disciplinary hearing found her guilty.
Mrs Nkosi has been on suspension since 20 February 2009 as a result of allegations of financial mismanagement against her. Mrs Nkosi was suspended pending the findings of an independent forensic investigation conducted by Nkonki Advisory Services (Nkonki). The decision to institute the investigation was taken by the PanSALB Board in a meeting held on 19 and 20 February 2009.
Nkonki presented a preliminary report to PanSALB during August 2009. Its final report was submitted on 4 September 2009. The forensic report recommended that Mrs Nkosi be charged with misconduct subsequently, 14 charges were brought against her. These included the following: Failure to appoint a Bid Adjudication Committee in Writing, Contravention of Treasury Regulations, Contravening Regulation 15(1)(a) of the PanSALB Regulations, Making Incorrect Statements, Financial Misconduct and other charges.
The enquiry which was delayed predominantly by court actions finally took place over several days from December 2010 to February 2011. The hearing was finally concluded on 17 February 2011.
On 8 June 2011 Ms Nkosi was found guilty and on 24 June 2011 the Chairperson of the enquiry recommended that Mrs Nkosi be dismissed. The Board endorsed the recommendation thus dismissed Mrs Nkosi.
“The Board is aware of the fact that dismissal is a harsh penalty with serious consequences for an individual. Nevertheless an organisation is entitled and sometimes obliged to respond effectively and decisively to misconduct of the nature proved in this case.
The mitigating factors did not persuade the Board that a penalty less than dismissal would be appropriate,” said Dr Elias Malete, Chairperson of the Board.
