The North West High Court ruling that there was no binding agreement between the North West Housing Corporation and MR Property Developers (Pty) Ltd on the sale of Wimpy, Kagiso and Kamogelo flats is a victory for the people of the North West Province and should have sent an unequivocal message that the North West Provincial Administration will do everything in its power to recover state properties lost through controversial transactions, North West Premier Thandi Modise said in welcoming the ruling on Saturday.
In his ruling delivered on Thursday, Judge Landman dismissed MR Property Developers (Pty) Ltd claim of R22, 6 million against the North West Housing Corporation with costs. The Judge further ruled that the applicant is to pay the respondents costs of the interlocutory application on an attorney client scale as from 16 July 2011.
The ruling follows close on yet another victory scored in recovering Oberon Holiday Resort in Madibeng Local Municipality.
