NSFAS Board statement on the outcome of part of the court proceedings

The NSFAS Board welcomes today's judgment of the Pretoria High Court granting interim relief suspending the appointment of the NSFAS Administrator and reinstating the Board pending the final determination of Part B of the review application.

The Board welcomes the Court's ruling and the opportunity to resume its governance responsibilities, while noting that Part B of the application, which concerns the review and setting aside of the appointment of the Administrator, remains to be determined by the Court.

The NSFAS Board will resume its duties with immediate effect and will focus on stabilising the institution, strengthening governance, and fulfilling its statutory mandate to provide financial assistance to eligible students across South Africa.

The Board has noted the various concerns and issues that have emerged in the public domain regarding the institution and will attend to these matters as a priority. Where any wrongdoing, misconduct or unlawful conduct is identified, appropriate action will be taken in accordance with the law and applicable governance processes.

The Board further reaffirms its commitment to working constructively with the Minister of Higher Education and Training and all relevant stakeholders in addressing the challenges facing NSFAS and the broader higher education sector.

As the matter remains before the courts and Part B of the proceedings is still pending, the NSFAS Board considers it inappropriate to comment further at this stage.
