The National Prosecuting Authority (NPA) and Adv Knorx Molelle have reached an out of court settlement in the in Johannesburg Labour Court today.
This is after Adv Mollele had instituted an urgent application to have his suspension lifted and his powers to institute asset forfeiture proceedings on behalf of the National Directorate of Public Prosecutions (NDPP) restored. The terms of the settlement are that his suspension is lifted and he will now be able to exercise his delegation in asset forfeiture proceedings.
Investigations into the allegations of misconduct are still underway and he has been ordered not to interfere with such investigations and or witnesses. He is currently on vacation leave and expected to resume his duties on 3 October 2011.
The settlement is informed by the NPA’s desire to focus on the internal processes that are unfolding and to ensure the interests of both parties are safeguarded.
