North West High Court dismisses Ngaka Modiri Molema’s court case

On 3 September 2014, the North West Provincial Executive Committee (EXCO) took a decision to dissolve council of Ngaka Modiri Molema District Municipality. On 11 September 2014, Ngaka Modiri Molema District Municipality launched an application with the High Court in Mahikeng to interdict the provincial government from appointing an Administrator and for the court to suspend EXCO’s decision to dissolve council.

The provincial government opposed the application arguing that, for a substantial period of time, the municipality had persistently failed to fulfill its executive obligation under the Constitution and national legislation. The application was heard by the court today (25 September 2014) and an order was made immediately by the court dismissing the municipal's application with costs. The effect of the order is that the dissolution of the Council is effective and the Administrator should immediately assume his obligations and responsibilities in the municipality and ensure that basic services and compliance with legislative obligations are met.
