National Prosecuting Authority (NPA) denies investigating Julius Malema

The National Prosecuting Authority noted with concern the inaccurate and misleading statement issued by the Pro-Afrikaanse Aksiegroup (PRAAG) today. The statement claims that one Advocate Gerrie Nel has “confirmed that the DPP’s North Gauteng Division has launched an investigation” against the ANC Youth League president Mr Julius Malema on the alleged “hate speech” incident. We wish to clarify that the NPA is not investigating Mr Malema for any offence.

The NDPP’s office received representations from the PRAAG requesting that the NPA look into possible prosecution of Mr Malema pursuant to the hate speech incident and for possible contravention of the Rome Statute.

They claimed to have opened a case docket with the police but could not produce any case number to prove registration of such a case. We then checked if the DDP North Gauteng office has received such docket and Advocate Sibongile Mzinyathi, DPP North Gauteng has denied any knowledge of the matter.

We wish to remind all that the NPA does not conduct investigations and only the police have those powers after a case docket is registered with them. It is also not correct that it is Advocate Gerrie Nel who wrote the letter acknowledging receipt of those representations to Dr Dan Roodt of PRAAG but another official who shares the same surname with Advocate Nel.
