Today the Constitutional Court handed down reasons for an order made on 14 August 2012. In that order the Court extended the period within which Parliament is required to cure a constitutional defect in a provision of the Road Accident Fund Act (Act), in terms of a previous order of this Court.
On 17 February 2011 certain parts of that provision of the Act were declared constitutionally invalid. The declaration of invalidity was suspended for 18 months to enable Parliament to correct the defect. Parliament was unable to pass the amending legislation within the period of suspension due to the fact that the Bill had to be revised substantially following a consultation process with interested parties.
The Constitutional Court was satisfied with the explanation furnished by the Minister of Transport and the Road Accident Fund for the requested extension. The period of suspension was extended for a further six months.
