Minister Nhlanhla Nene announces members of SARS Advisory Committee

The Minister of Finance has today announced the members of the Advisory Committee that has been set up in terms of section 11 of the South African Revenue Service (SARS) Act 1.

This follows the Minister’s announcement in February that he would appoint an advisory committee to be chaired by retired Judge Frank Kroon to advise him and the SARS Commissioner on a number of strategic and governance matters relating to SARS.

The Minister presented the names of the committee members he appointed to Cabinet for noting. The committee will be appointed for a period of one year and will begin its work immediately.

The Members of the Advisory Committee are:

Judge Frank Kroon

Judge Frank Kroon is a retired Judge of the High Court of South Africa. He was appointed as Judge in 1985, having practiced as an advocate from 1964 to 1983. He has served as an acting Judge in the Constitutional Court, the Supreme Court of Appeal and the Labour Appeal Court. In 1995, Judge Kroon was Chair of a Commission of Enquiry into violence at Tsolo. He retired from the bench in 2011.

He studied law at the University of Cape Town from 1959 to 1963.

Advocate Selby Mfanelo Mbenenge

Selby Mfanelo Mbenenge was admitted as an advocate in 1989 and has extensive experience that includes serving as a Public Prosecutor and State Law Advisor. He has also acted as a Judge in the High Court and in the Labour Court.

Advocate Mbenenge has an LLB degree from the University of Transkei.

Mmakgolo Meta Maponya

Ms Mmakgolo Meta Maponya is a qualified Chartered Accountant. She has extensive experience in public sector finance gained through advising, amongst others, the Department of Environmental Affairs, the Social Housing Regulatory Agency, and Limpopo Housing. She also has investment banking experience gained at Investec Corporate Finance. Ms Maponya has served on a number of boards, including AON, Broadband Infraco, Road Agency Limpopo and is a member of the Audit Committee of the Department of Correctional Services.

She has a BCom Honours Degree from the University of Natal that includes special focus in Advanced Auditing and Advanced Taxation. She passed her board examination in 2003.

Lazarus Docter Mokoena (known as “Bonga”)

Bonga Mokoena is currently a Managing Director of Actuarial and Consulting Solutions & Public Sector Divisions at Alexander Forbes Financial Services Holdings.

Prior to joining Alexander Forbes Financial Services, Mr Mokoena was the Chief Executive and Principal Officer of the Eskom Pension and Provident Fund where he had overall responsibility and accountability for Eskom’s in-house Retirement Fund Administration operations. He has also held various senior management and executive leadership positions at Nedbank, Transnet and Old Mutual South Africa.

Mr Mokoena has a B. Com (Wits),  Hons B. Compt/CTA (Unisa), Masters in Business Leadership (Unisa SBL) and is also a qualified CA (SA).

Rudolph Mastenbroek

Rudolph Mastenbroek is currently an advocate with 20 years’ experience in the public service and academia. He spent eight years at SARS between 2005 and 2013, which included a 30 month secondment to the National Prosecuting Authority where he was a member of the presidentially established Anti-Corruption Task Team. He had previously worked for the NPA for six years.

His qualifications include a BA Law from the University of Stellenbosch and a Post Graduate Diploma in Taxation from Rhodes University. He was admitted as Advocate of the High Court of South Africa in 2000.

SARS Commissioner Mr Tom Moyane has appointed two senior officials from SARS to the committee, Mr Jonas Makwakwa and Mr Matsobane Matlwa.

Mr Jonas Makwakwa

Mr Jonas Makwakwa is currently the Group Executive responsible for Audit at SARS and the Acting Chief Operations Officer. He joined SARS in 1995 as an auditor after completing his junior degree (B Com Accounting).

A top SARS auditor for over 3 years, he was promoted to the position of Regional Auditor in 1999 and then to National Manager Enforcement responsible for 5 divisions (Debt Management, Audit, Criminal Investigations, Estates and Outstanding returns). In 2006 he became General Manager: Enforcement and was a member of the SARS EXCO until 2009. His qualifications include a Diploma in Business Management as well as a Global Executive Development Programme with GIBS which included studies in Singapore and Malaysia.

Mr Matsobane Matlwa

Mr. Matsobane Matlwa is currently Chief Financial Officer at SARS, a position he assumed in December 2014. He was previously the CEO of Matlwa Consulting,  a management consultancy he founded. He has also worked as CEO of the South African Institute of Chartered Accountants (SAICA), served SARS in various senior managerial positions including Group Executive for the Large Business Centre and was a General Manager at

Absa amongst others. He has served on the boards of several companies including SAA, Transnet, JD Group and SASOL

Mr Matlwa is a qualified Chartered Accountant and holds an MBA from Alabama University in the United States, a Master of  Commerce (Taxation) from the Graduate Institute of Management and Technology (South Africa) and has completed management programmes from the University of Cape Town and the University of Potchefstroom.

The Advisory Committee

The primary task of the Advisory Committee will be to guide the direction of long-term strategy at SARS by ensuring that decisions about SARS operations, personnel, budget and technology support its long-term strategy and plans.

The committee will do this by advising the Minister of Finance on SARS:

  • Proposed strategic and business plans, goals and measures relating to those plans;
  • Operational and organisational  plans, including  modernisation of technology systems, training, and reorganisation of business units, and
  • Budget to ensure that the budget supports the revenue and customs authority’s strategic and business plans.
  • Review of current governance structures at SARS.

In addition, the committee will review the events that have been reported on by the media in recent months and advise the Minister and the Commissioner about the best way to prevent such from occurring again.
