The Premier of Limpopo Provincial Government, Mr Cassel Mathale welcomes the judgement by the Constitutional Court of South Africa on the matter concerning whether the Limpopo Provincial Legislature has the authority to pass legislation to deal with its own financial management.
“The judgement has assisted to remove any uncertainty about the authority to legislate on financial matters,” said Premier Mathale.
This matter is based on the Legislature’s Finance Management Bill which was referred to the Premier for assent as required by the Constitution of the Republic of South Africa.
The Premier had reservations about the constitutionality of the Bill and consequently he referred it to the Constitutional Court for certification. The Constitutional Court ruled in favour of the Premier that the Provincial Legislature does not have the authority to pass a legislation of that nature.
