MEC for Local Government, Environmental Affairs and Development Planning, Western Cape Province in re: Minister for Mineral Resources and Swartland Municipality and Others and Maccsand (Pty) Ltd and the City of Cape Town and Others

The following explanatory note is provided to assist the media in reporting this case and is not binding on the Constitutional Court or any member of the Court.

Today, the Constitutional Court handed down an order varying the costs orders issued in cases CCT 102/11 and CCT 103/11

The application for variation was lodged by the Member of the Executive Council for Local Government, Environmental Affairs and Development Planning of the Western Cape, on 16 April 2012. The basis on which the variation of the order was sought was that the orders contained patent errors.

This Court considered the application and ruled that, in respect of case number CCT 102/11, there was a patent error in the costs order issued. The order was corrected. With regard to case number CCT 103/11, the Court held that there was no error in the order and refused the request for variation.
