MEC Anton Bredell notes granting of an interim Court Interdict obtained by Swellendam Municipality

MEC Bredell takes note of the successful interim interdict obtained by Swellendam Municipality against individuals or organisations for inciting or partaking in illegal protest activities.

Anton Bredell, Western Cape MEC of Local Government, Environmental Affairs and Development Planning today noted the granting of an interim Court Interdict obtained by the Swellendam Municipality against certain individuals and organisations. 

“This interdict prevents these individuals, organisations, or any affiliation of or with them to organise or partake in any activity that can be seen as planning illegal actions in Swellendam,” MEC Bredell said.

The respondents in the application document which served before the Western Cape High Court are:

  • Sello January Maela
  • Sivuyile Ngcapuka
  • Vuyo Hlcoto
  • Riaan Jonas
  • Julian Matthysen
  • Mtyanga Monwabisi
  • The African National Congress Party
  • All individuals or groups of persons who associate with and/or gather with the above respondents in the municipal area of the Swellendam Municipality
  • The Minister of Police
     

Bredell said the interdict, which will be made final on 20 October, prevents the respondents, excluding the Police Minister, from doing the following:

  • Conducting unlawful protest action.
  • Causing damage to property.
  • Causing violence.
  • Intimidation of third parties, and
  • blocking of roads.
     

It is also noted that the Honourable Justice Samela made a cost order against the respondents and in favour of the Municipality, MEC Bredell said. “This court verdict should be seen as a strong message that unlawful behaviour is not acceptable.  A next step must be to hold those responsible for the unrest in Swellendam accountable and institute damages’ claims against them if their guilt can be established in a court of law.”
