Labour on Employment Equity reporting, Amendment Bill and Regulations

Labour inspectors may request and obtain written undertakings from designated employers to comply with equity law – roadshow told

A labour inspector may make an application to the labour court if a designated employer fails to comply with the provisions of the employment equity law, a meeting was told in Witbank, Mpumalanga on Tuesday.

Niresh Singh, Deputy Director in the Employment Equity directorate, was addressing the roadshow focusing on EE reporting, Amendment Bill and Regulations.

“If the inspector has reasonable grounds to believe that the employer has failed to: consult with employees as required by the law – conduct an analysis as required by legislation and prepare an employment equity plan as stipulated by section 20 of the Act, he/she may lodge an application with the labour court.

The Department of Labour’s national public hearings on the Employment Equity Amendment Bill & Regulations are set to continue in two more provinces this week.

The national roadshows which commenced on October 02 2018 have already visited the provinces of Eastern Cape, Western Cape, Kwa-Zulu Natal, Northern Cape and the North West.

The roadshows will continue tomorrow at Hayani Guest Lodge, 19 Palmietfontein Rd, Polokwane, and will be followed by Free State province on Thursday 18 October in Kopano Nokeng Lodge, 14 Mazelspoort Rd, Bloemfontein.

The public hearings are open to employers or heads of organisations, academics, assigned senior managers, consultative EE forum members, human resource practitioners, trade unions representatives and employees.

Held under the theme” Real transformation makes business sense” the public hearings are focused on soliciting comments from stakeholders on the amendments and EE reporting advocacy. The Department of Labour recently published the Employment Equity Amendment Bill and the Draft Employment Equity Regulations in the Government Gazette in response to the slow pace of transformation in the workplaces. The Department is using the public hearings to gather comments to the amendments.

The EE public hearings are held from 08:30 to 14:00. The public hearings will culminate on 26 October 2018 in Johannesburg, Gauteng province. Comments to the amendments will be accepted until November 20.

NB: The EE 2018 Online reporting season is now open. The online EE reporting closes on 15 January 2019.
