Labour on Compensation Fund Amendment Bill

The labour market will be turned on its head in the area of inspection with the compensation fund (CF) about to introduce its team of specialist inspectors.                                                                                        

This was announced at the CF’s public hearings on amendments of Compensation for Occupational Injuries and Diseases (COID) in Klerksdorp, North West on 26 November 2018.

Advocate William Mogashoa, Director: Legal Services at the Fund said these specialist inspectors will replace or take over the work previously done by inspectors of the Department’s Inspection and Enforcement Services (IES) Section. “We realised that the current arrangement is not achieving desired results. That is why we want to have our own compliance and enforcement people”.

He said such inspectors will have the powers under the new Act to inspect and issue fines to ensure compliance. He said advertisements have already gone out for the recruitment of specialist inspectors.

Hlonitshwa Mpaka, Director Communication at the fund requested stakeholders to provide written inputs by December, 18.

The most significant amendments proposed in the COID Bill are:

  • Inclusion of domestic workers under the category of employees for purpose of benefits in terms of the Act
  • Rehabilitation and Reintegration framework of injured and or diseased employees into the workplace
  • Administrative amendments
  • Improvement of some benefits

The Compensation for Occupational Injuries and Diseases Act applies to all employers; casual and full time workers who sustain workplace accident (are injured, disabled, or killed) or work- related diseases.

The COID Amendment Bill public hearings roadshow started on 19 November in Upington.

  • Pietermaritzburg – Ascot Wedding and Conference Centre on 06 December 2018
  • Port Elizabeth – The Beach Hotel on 10 December 2018
  • East London – Premier Hotel Regent on 11 December 2018
  • Cape Town – Stellenbosch Lodge on 12 December 2018
  • George – Chilly and Chive Lodge on 13 December 2018
