These payments will be effected from the President Fund, which was established in accordance with the Promotion of National Unity and Reconciliation Act and regulations outlined by the President. According to the regulations the payment of the final reparation is limited to persons who appeared before or made statements to the TRC and were declared eligible for reparations. It is important to note that as this process has been concluded, new applications will not be considered. In instance where the listed beneficiary is deceased, the rightful next-of-kin are invited to apply for payment. In these cases, beneficiaries should be aware that their relationship would need to be verified to avoid unlawful payments.
This call is part of government’s attempt to implement the approved TRC recommendations relating to the reparations of victims, which includes these once-off payments, medical benefits and other forms of social assistance, establishment of a task team to investigate the nearly 500 cases of missing persons and the prevention of future gross human rights violations and promotion of a firm human rights culture. In order to effectively implement these recommendations, the government established a dedicated TRC Unit in the Department of Justice and Constitutional Development which is intended to expedite the identification and payment of suitable beneficiaries.
How to claim?
- In order to claim, beneficiaries listed on this publication should bring along their identity documents and proof of their banking details.
- In instance where the listed beneficiary is deceased, their rightful next-of-kin should bring along their identity document and the death certificate. The President’s Fund Office then sets out to determine the rightful next-of-kin, guided by the principles of the law applicable in effecting succession. Once the rightful next-of-kin is established, payment can be made. Where more than one person qualifies as the rightful next-of-kin, the money is divided between them.
Beneficiaries are allowed to forward their claim through a fax or post, but should always ensure that certified documents are attached.
Payments are done electronically and are paid into the bank accounts of the beneficiaries, in accordance with the banking details supplied by them.
