Justice and Constitutional Development Committee calls for nominations for Deputy Public Protector post

In accordance with the Public Protector Act, the Justice and Constitutional Development Portfolio Committee is calling for nominations for a suitable person to serve as the Deputy Public Protector. The term of office of the current Deputy Public Protector comes to an end on 30 November 2012.

The Public Protector is mandated to strengthen constitutional democracy by investigating and redressing improper and prejudicial conduct, maladministration and abuse of power in state affairs, resolving administrative disputes or rectifying any act or omission in administrative conduct through mediation. This office is also responsible for conciliation or negotiation, advising on appropriate remedies or employing any other expedient means and discharging other responsibilities as mandated by legislation.

The nominee must be a South African citizen. The candidate must also be admitted as an advocate or an attorney, and has for a cumulative period of at least ten years after being admitted practised as an advocate or an attorney, or is qualified to be admitted as an advocate or an attorney, and has for a cumulative period of at least ten years after having qualified, lectured in law at a university.

The nominee must also have specialised knowledge of or experience in the administration of justice, public administration or public finance, has been a Member of Parliament for a cumulative period of at least ten years, or has acquired any combination of experience mentioned above for a cumulative period of at least ten (10) years.

The successful nominee shall be appointed as Deputy Public Protector for a period determined by the President, but not exceeding seven years. The remuneration and other terms and conditions of employment will from time to time be determined by the National Assembly. The Deputy Public Protector will have such powers as may be delegated by the Public Protector. Whenever the Public Protector is unable to perform the functions of her/his office or while the appointment of a person to the office of Public Protector is pending, the Deputy Public Protector will perform such functions.
