The Commission for Gender Equality welcomes the sentencing of Mvumeleni Jezile

The Commission for Gender Equality (CGE) welcomes the 22 years sentence handed down to, Mvumeleni Jezile for trafficking a 14 year old girl as a wife to Cape Town The Children’s Act and Child Justice Act as well as Human Trafficking, Marriage Act, Recognition of Customary Marriages Act have all been flouted in this case. The victim’s constitutional rights, dignity and freedom have been impugned by the perpetrator in collusion with the family.

“The CGE hopes that this sentencing will send a strong message that  human trafficking, rape, assault and other related matters against young girls are being taken seriously by the criminal justice system,” said Mr Mfanozelwe Shozi the Chairperson of the Commission for Gender Equality.

We are, concerned, further, about mitigating factors presented by Jezile’s counsel who sought to paint the perpetrator as a victim of the cultural practice of Ukuthwala whereas there is compelling evidence to suggest otherwise. Twenty years on in our democracy, when all efforts are being made to educate the public against harmful and inhumane cultural practices, the CGE still comes across cases where the Constitution is being violated with impunity.

Having been found guilty on all counts, we believe is a reason enough for the Judge to give the 22 year sentence, as this will serve as a deterrent to the “would be” human traffickers in our society. We are appreciative of the fact that the precedence set in this case, may give courage to other victims of Ukuthwala to stand up for their rights.

The commission calls on South African men and families to distance themselves from this culture of Ukuthwala that seeks to rob minors and girls of their fundamental human rights. The CGE therefore welcomes the 22 year jail sentence handed to Jezile.
