Employment and Labour on Employment Equity reporting

Employment Equity (EE) roadshows come to an end and now the spotlight falls on EE reporting

As the curtain falls on the Employment Equity (EE) roadshows/workshops the spotlight turns to employers to ensure they submit their EE reports on time.

Also, the proclamation notice for commencement date of the amended Employment Equity (EE) Act is still pending, employers have been advised to use existing legislation when reporting on their EE status.

The EE Amendment Bill was assented into law on 6 April 2023 by the President Cyril Ramaphosa and it is still awaiting his signature for the implementation date.

Department of Employment and Labour Deputy Director: Employment Equity, Niresh Singh, told stakeholders during a joint Departmental EE workshop with the Commission for Conciliation, Mediation and Arbitration (CCMA) at Lagoon Beach Hotel in Cape Town that employers should start submission of their EE reports using the current law.

“As you make arrangements and preparing to submit your reports be mindful of amendments. As soon as the commencement date is announced let's prepare for the new changes and prepare for sector targets in future," Singh said.

The Employment Equity reporting season opened on 1 September 2024 and will close on 15 January 2025.

The Department of Employment and Labour, and Commission for Conciliation Mediation and Arbitration have since 06 August 2024 been conducting the annual employment equity advocacy sessions. This year the Department has conducted 17 of these national workshops in all provinces.

In 2024 workshops were held under the theme: “Bridging the Equity Gap Through Diversity & Inclusion" focused on:

  • The EE status of the labour market as per 24th CEE Annual Report;
  • An update on the EE amendments, in particular the proposed draft regulations on proposed sector EE targets;
  • An update on the 2024 EE reporting season;
  • Key insights from the CCMA on topical cases related to unfair discrimination in terms of harassment, disability and discrimination based on arbitrary grounds.

The EE workshops were targeted at employers or heads of organisations, academics, assigned senior managers, consultative forum members, human resource practitioners, trade unions, employees and interested stakeholders.
