Death as a result of police action: Gugulethu

On 29 January 2010 at 18h00 it is alleged that the deceased, a 49 year old coloured male and a witness visited a tavern in NY 109 Gugulethu. Whilst at the tavern, the deceased was sitting outside the tavern where he was playing a game. The witness was standing aside when the South African Police Service (SAPS) arrived. It is alleged that the deceased uttered words towards the SAPS members when one of the SAPS members smacked the deceased on the right cheek and the deceased fell backwards hitting his head on the pavement.

It is alleged that the two SAPS members loaded the deceased into the back of the patrol vehicle by picking him up on each side and then throwing him into the back of the van. Apparently the deceased was bleeding from his mouth and nose whilst in the back of the van.

The deceased was then transported to the Gugulethu Day Hospital; he was later transferred to Groote Schuur Hospital (GSH) where he died on Saturday 30 January 2010 at 10h00.

The Post Mortem (PM) was conducted on Saturday 30 January 2010 at 15h00 at Salt River Forensic Pathology Services (FPS). The cause of death is a head injury to the right side of the back of the head/fractured skull.

The deceased also had bruising to his right cheek indicating that he received blunt trauma to the cheek. The post mortem was attended by Independent Complaints Directorate (ICD) investigators.

A murder docket has been opened and is being investigated by the ICD Western Cape provincial office.
