The South African Police Service (SAPS) issued a media release statement on Friday night, 1 June 2012, in which it criticised and decried the circumstances under which Lieutenant General Richard Mdluli obtained an order in the Labour Court re-instating him to his position within the service.
In the media statement, it was announced that the SAPS intended to bring an urgent application in the Labour Court to challenge the order which was obtained by General Mdluli. The SAPS was confident that due to the information that it had at its disposal it had excellent prospects of success in the urgent application.
The SAPS is pleased to announce that on Sunday, 3 June 2012, it obtained an order rescinding and setting aside the order which was obtained by General Mdluli on Friday. The SAPS was of the view that the order was obtained under inexplicable and questionable circumstances. The SAPS has now been vindicated in its belief that General Mdluli should not have been granted such an order.
“On behalf of SAPS management, I welcome today’s ruling as a sound decision of the Labour Court”, said Acting National Commissioner, Lieutenant General Nhlanhla Mkhwanazi.
The legal implications of the court ruling today is that General Mdluli remains suspended from the Police.
The initial application of General Mdluli was due to be heard on Monday the 04th June 2012, however, it was brought forward and heard on Friday the 01st June 2012 at the instance of General Mdluli’s Lawyers. The effect of today’s order is that there will be no hearing tomorrow at the Labour Court, until we hear from General Mdluli’s lawyers.
