Correctional Services' decision to defend a legal challenge of the awarding of nutrition tender was made in January 2010

The Department of Correctional Services wishes to reject as “gross distortion and mischievous” any claims that the new National Commissioner Tom Moyane made a decision to defend the legal challenge of its decision to award a nutrition tender in January 2009.

To put the record straight, the department had made a decision to defend its interests against a legal challenge by Royal Sechaba on 25 January 2010.

Commissioner Moyane only assumed duties on the 15 May 2010 and was briefed of the decision to defend two weeks later by the former Acting National Commissioner Jennifer Schreiner. Commissioner Moyane applied his mind and confirmed the defence of the matter.

The department also rejects the claim that lawyers were fired. The lawyers mentioned were replaced after they indicated in August 2010 that they were not available to defend the interests of the department in this matter. It is after their decline that other counsel had to be briefed to do as such.

As will be heard during the court proceedings, Commissioner Moyane’s strong views against fraud, corruption and serious maladministration are very clear, as he has taken a zero tolerance stance since his assumption of duty, building on the department’s anti-corruption stance.

We reject all insinuations aimed at tainting the good image and reputation of National Commissioner Moyane. He remains determined to fight fraud and corruption in all its forms.
