The service level agreement that the North West Housing Corporation had entered with a turnkey consultant for the disposal of its properties listed in its rental portfolio has been terminated, North West MEC for Human Settlements Public Safety & Liaison, Ms Desbo Mohono confirmed on Wednesday.
The North West Housing Corporation (NWHC) had in and around October 2007 entered into a written Service Level Agreement (SLA) with Lebogang Kevin Seriba (Seriba) of Microzone Trading 1233 for the disposal of the properties spread across the North West Province, Gauteng, Free State and Northern Cape in compliance with a court order granted by the High Court of Bophuthatswana Division on 6 September 2007 under Case No: 379/2005.
In accordance with the SLA entered into between the NWHC and Seriba, the mandate given to Microzone Trading 1233 included, inter alia sale of properties, lease of properties, collection of proceeds of sales, and monthly rentals.
The SLA was effectively and legally terminated by the NWHC on June 20, 2011 after the service provider failed to comply in full with the material terms of the SLA and therefore, was found to be in breach of the agreement.
Effectively from the date of termination of the SLA, Seriba’s company was no longer mandated to conclude any sale of agreements, lease of agreements, including collection of any proceeds (monies) of such sales and occupational monthly rentals.
Notwithstanding the termination, it has come to the urgent attention of the NWHC, including the North West Department of Human Settlements, Public Safety & Liaison that the company allegedly continues to execute the mandate in accordance with the SLA, despite its lawful termination.
The department has in recent weeks received numerous complaints and allegations from members of the public about the alleged illegal execution of the terminated mandate by Seriba and or his company.
MEC Mohono calls upon those affected by the situation to formally lodge their complaints with the department for full investigation and appropriate steps to be taken.
