The Portfolio Committee on Home Affairs has noted North Gauteng High Court Ruling against the Department of Home Affairs in relation to the deportation of Mr Edwin Semotse to Botswana despite a court order against the deportation.
This judgment brings to three the number of rulings against the department by a court of law and a Chapter 9 institution within the past few weeks. It is concerning that all three judgments point to an incessant breach of the Constitution by the department. Furthermore, they highlight challenges with the processes and systems within the department that need urgent attention.
The Committee will as soon as possible engage the department in efforts to establish reasons that lead to continuous litigation with the aim of finding lasting solutions.
