The select Committee on Cooperative Governance and Traditional Affairs will tomorrow embark on an oversight visit to Msunduzi Municipality to determine whether procedural requirements have been met by the Provincial Executive Council when it decided to intervene in the municipality.
The Provincial Executive Council intervened in the municipality in the context of Section 139(1) (b) of the Constitution. In terms of this Section, when a municipality cannot or does not fulfil an executive obligation in line with the Constitution or legislation, the relevant provincial executive may intervene by taking any appropriate steps to ensure fulfilment of that obligation, including assuming responsibility for the relevant obligation in that municipality.
The decision to intervene in the municipality was taken after the assessment of the municipality’s finances and reports.
The committee will interact with various stakeholders including community members, traditional leaders, business community and municipal leaders.
After getting information from all stakeholders, the committee will decide whether to approve or disapprove the decision by the Provincial Executive Council to intervene in the municipality.
