Call for nominations to appoint two full-time members to serve on the National Consumer Tribunal

The National Consumer Tribunal was established as a juristic person with jurisdiction throughout the Republic of South Africa through the National Credit Act, 2005 (Act No. 34 of 2005).

In terms of the provisions of Section 26 (2) of the National Credit Act, 2005, the Minister of Trade and Industry, Dr Rob Davies, hereby calls for nominations to appoint two full-time members to serve on the National Consumer Tribunal to be appointed by the President.

Functions of the National Consumer Tribunal

The Tribunal or a member of the Tribunal acting alone in accordance with the National Credit and Consumer Protection Acts may:

  • Adjudicate on allegations of prohibited conduct by determining whether prohibited conduct has occurred and, if so, by imposing a remedy provided for in terms of legislation;
  • Grant an order for costs in terms of the legislation; and
  • Exercise any other powers conferred on it by legislation.

Requirements

In terms of Section 28 of the National Credit Act, “the member of the Tribunal must represent a broad cross-section of the population of the Republic; be a citizen of South Africa, who is ordinarily resident in the Republic; have suitable qualifications and experience in economics, law, commerce, industry or consumer affairs; and be committed to the purposes of the Act.”

In addition, the two full-time Tribunal members would be required to provide support to the chairperson through efficient management and adjudication of cases referred to the Tribunal without compromising the integrity of the Tribunal; ensure high-quality and professional services are rendered in relation to complaints within set time frames and in line with the relevant legislation; assist with the compilation of strategic and business plans; communicate, implement and monitor the plans; ensure alignment of business and strategic plans with the budget; manage and monitor performance of other internal departments that fall under the Tribunal and ensure collaboration with registry management to enable effective flow of work processes that supports and enhances efficient delivery of services to clients.

Term of office of the full-time Tribunal members

The full-time Tribunal members will be appointed for a period of five years and the effective date of appointment shall be determined by the Minister.

Remuneration of the full-time Tribunal members

Successful candidates will receive an annual salary package of R1 076 619.00 (all inclusive).

Nomination procedure

Nominations must be submitted in writing and contain a detailed Curriculum Vitae, motivation for appointment, and certified copies of identity document and qualifications.

Nominees must note the following:

  • Background verification, including criminal record and citizenship checks, will form part of the selection process;
  • Preference will be given to candidates whose appointment will enhance representivity;
  • It is the nominee’s responsibility to have foreign qualifications verified by the South African Qualifications Authority (SAQA);
  • Shortlisted candidates will be subjected to the necessary security clearance;
  • Correspondence will be limited to shortlisted members only; and
  • No late nominations or facsimile transmissions will be accepted.

Additionally, the following forms must be completed and submitted and can be obtained from the dti website:

  • A signed and completed nomination and acceptance form (Form 1 A);
  • A signed and completed form relating to the particulars of the nominee (Form 1 B);
  • A written disclosure of business interests and membership in other Boards/committees/councils information sheet; and
  • Consent for risk analysis conducted by EMPS form.
