Ananda eviction dispute hearing postponed

The case of a Rustenburg family facing eviction from Ananda Country Lodge premises was postponed by the North West Rental Housing Tribunal during its hearing held on Monday. The hearing was postponed to Friday 20 May 2011 to allow the Reinecke family to seek legal representative from the legal aid board.

North West Rental Housing Tribunal is mediating in the case of the Reinecke family which is one of other families evicted from the Ananda Country Lodge premises. The Reinekes are the last of the four families remaining in the premises after the property was bought by the Royal Bafokeng Administration in the past few months. Now the family is contesting the eviction as they have been staying there for the past 17 years.

The family stayed in an area allocated to be a caravan park, and the place has been home for them for almost two decades. Now the business premises has been sold to the Royal Bafokeng Administration. Since the place was sold more than 50 families have been evicted from the premises. Among others, the Reinecke family is charged with non- payment of rent by Ananda County lodge in Rustenburg, amounting to over than sixty thousand rands.

According to the charges brought by Ananda Country Lodge, the Reinecke owes the lodge more than R60 000 in rental money and that the family erection of an unauthorised immovable building within the premises. Fifty-one year old Vic Reinecke who is a former employee at the Lodge is currently unemployed and survives on pension money of just over two thousand rand, says that he does not owe Ananda a cent. He further says that he has nowhere to go if evicted. Reinecke stays with his wife on the premises and pays rent amounting to R750 per month.

Ananda wants the tribunal to cancel the lease agreement it has with Mr Reinecke and also terminate operational rights as linked to the contract. The tribunal wants to find an amicable solution to resolve the feud between the two parties.

North West MEC for Human Settlements, Public Safety & Liaison, Desbo Mohono says that her department will intensify its communication efforts to ensure that all people are aware of the existence of the tribunal and the service it renders to and ensure that it delivers on its mandate and is able to account for resources deployed towards discharging its responsibilities.

“Protecting both landlords and tenants against unfair practices as well as providing effective mechanism to resolve disputes that may arise from time to time between both parties, is a task of monumental proportions for the tribunal,” says MEC Mohono.
