Alleged conflict of interest by the Speaker of Gauteng Provincial Legislature (GPL) during the official opening of the Gauteng Provincial Legislature held on 20 February 2012

The GPL Integrity Commissioner (IC) has taken note of recent media reports alleging conflict of interest by the Speaker of (GPL), and has today decided to initiate an investigation in accordance with the Standing Rules and Code of Conduct and Ethics for members. Article 12 (3) (a) of the Code of Conduct and Ethics states that: “the Integrity Commissioner may on his/her own accord, investigate any alleged violation of the code of conduct and ethics”.

In due course, the IC will invite all the parties involved in the matter including but not limited to, the Speaker of the GPL, Administration Team that was involved with the organising of the opening of the GPL, companies that were awarded the tender and all other interested parties.

In addition the IC will be reviewing the register of members' Interest with regard to the Speaker's disclosure of financial interest. After conclusion of the investigation, the IC will submit a report with recommendations to the Privileges and Ethics Committee, which is a multiparty Committee of the Legislature. After due consideration of the IC report, the Committee will submit its own report with recommendations for consideration and resolution by the House.

The IC is an independent authority appointed by the two-thirds majority of the House. The IC is responsible for ensuring that all members of the GPL adhere to the Code of Conduct and Ethics for members, and is empowered to initiate investigations, receive complaints, adjudicate and make recommendations over the matters of potential breach of Code of Conduct and Ethics for members.

The IC is also responsible for the compilation of the Register of members' Interests wherein members disclose all their financial interests including but not limited to; properties they own, companies wherein they are shareholders or directors, including disclosure on financial interest of their immediate family members.
