Agriculture, Forestry and Fisheries on Fishing Rights Allocation Process

This statement provides an update on the Minister’s processes as he disposes of the administrative appeals filed by applicants against decisions taken by the Delegated Authority during FRAP 2013.

The Minister of Agriculture, Forestry and Fisheries Mr Senzeni Zokwana has commenced with the consideration and evaluation of all appeals lodged against the decisions taken during FRAP 2013 and has appointed three outside individuals independent of the department to Appeals Advisory Panel to advise the Minister on FRAP 2013 appeals. These individuals include Advocate Shaheen Moolla; Professor Julian Smith and Ms Mamakhe Mdhluli.

The Minister intends to announce his decisions systematically and on a sector-by-sector basis in the coming weeks. However, it is acknowledged that a number of applicants who had lodged appeals have requested access to additional data and information as the information that was originally made available was regarded to be inadequate. In this regard, the Deputy Director-General: Fisheries Management will make available to all appellants the following additional records:

1. The scoresheets for all other applicants in the fishery concerned. The scoresheets will be made available on www.daff.gov.za, and through the Fishery Control Offices along the coast. PDF versions of the files will be emailed to all appellants  who provided the department with email addresses; and
2. Access to the application forms of applicants for fishing rights. Viewing of the FRAP 2013 application forms will only be provided at Foretrust Building, Martin Hammerschlag Way, Foreshore, Cape Town during the normal working hours.

To view the FRAP 2013 applications, appellants are requested to contact Mr Msimelelo Mdledle and/or Ms Sive Mpika at MsimeleloM@daff.gov.za and/or SiveM@daff.gov.za to book a date and time.

Appellants will thereafter be afforded a limited period to supplement  their appeals lodged for FRAP 2013. Appellants shall be entitled to supplement their appeals by no later 16h00 on Monday, 13 July 2015. Kindly mark all supplementary appeals as follows:
 “Supplementary  Appeal”  |  “Appellant’s  Name  &  Application  Number”  | “Fishing Sector”.

Supplementary appeals must be submitted to the Minister: Agriculture, Forestry and Fisheries, for Attention: Mr. Saasa Pheeha, Customer Service Centre, Ground Floor, Foretrust Building, Martin Hammerschlag Way, Foreshore, Cape Town, 8001.

Supplementary appeals must be submitted by hand and/or by email. Supplementary appeals submitted by email shall be submitted only in a PDF format to  FRAP2013appeals@daff.gov.za. All documentation appended to the appeal must be certified by a Commissioner of Oaths as being a true copy of the original.

Appellants wishing to email supplementary appeals larger than 4MB must upload such documents on the website: http://www.daff.gov.za/upload/ and forward the link to  FRAP2013appeals@daff.gov.za. The Minister may make provision for the hearing of oral submissions where considered necessary and appropriate.
