Ad Hoc Committee considering Public Protector’s Report adopts draft report

The Ad Hoc Committee responsible for considering and reporting on the recommendations contained in the Public Protector Report no. 13 of 2013/14 today adopted its draft report.

The Committee has resolved that it is unable to accede to the “recommendations” or requests of the Public Protector, addressed to the Speaker of the National Assembly, on the grounds that to do so would be unlawful and/or unconstitutional.

The Committee has further recommended that the Electoral Commission, the Department of Home Affairs, the National Treasury and the Auditor General, complete the actions in which they are currently engaged in pursuance of the “remedial action” recommended by the Public Protector in her report, but only to the extent that it is legally permissible.

The committee’s report will appear on the Announcements, Tablings and Committee Reports (ATC) of Parliament this afternoon and is scheduled to be on the National Assembly’s Order Paper next week.
