Minister Mmamoloko Kubayi briefs media on key legislative amendment bills approved by Cabinet, 11 Aug

The Minister of Justice and Constitutional Development, Ms Mmamoloko Kubayi, together with the Deputy Minister, Mr Andries Nel, will brief the media on four bills recently approved by Cabinet, as part of the legislative programme for 2026.

The four bills, namely the General (Mining) Laws Amendment Bill, 2026, the Legal Practice Amendment Bill, 2026, and the Regulation of Trusts Bill, will be gazetted for public comments. The briefing will also provide an update on the Conspiracy, Instigation and Incitement to Commit Offence Bill, 2026, which has been approved by Cabinet and will be tabled in Parliament.

 The legislation is as follows:

General (Mining) Laws Amendment Bill, 2026: Introduces measures to address illicit mining and related offences, enhance enforcement, and safeguard communities and the country's mineral resources.

Legal Practice Amendment Bill, 2026: Seeks to strengthen the regulation and sustainability of the legal profession, including the Legal Practitioners’ Fidelity Fund, while advancing transformation and access to justice 

Regulation of Trusts Bill, 2026: Modernises the framework governing trusts, with a focus on stronger oversight, accountability and protection of beneficiaries. 

Conspiracy, Instigation and Incitement to Commit Offense Bill, 2026: The bill revokes the outdated Riotous Assemblies Act 1956. 

The briefing will also cover the recently increased monetary jurisdiction of the Small Claims Courts, highlighting the implications on access to justice, particularly for ordinary South Africans seeking affordable dispute resolution.
