The Western Cape Minister of Transport and Public Works Mr Robin Carlisle will be joined by the national Deputy Minister for Transport Mr Jeremy Cronin at the announcement of the newly establish Provincial Regulatory Entity for public transport (PRE) on 26 October 2011 at the Shared Services Centre – Vangate.

Background to the disestablishment of the Provincial Operating Licensing Board (POLB) and the Establishment of the Provincial Regulatory Entity (PRE) in accordance to the National Land Transport Act (Act no. 5 of 2009)
The National Land Transport Act (NLTA) - Act no. 5 of 2009 marks a fundamental shift in the land transport arrangement and requires the establishment of a number of requisite entities. The MEC of responsible for Transport in each province must take immediate steps to disestablish the Provincial Operating License Board (POLB) and establish a Provincial Regulatory Entity (PRE) to take over the functions of the POLB. The PRE will deal with all intra-provincial applications (within the boundaries of the province) unless the operating license function is assigned to a particular municipality in that province in terms of section 11 of the act.
In accordance with section 23 of the NLTA, the Western Cape Department of Transport has taken a decision to disestablish the current Provincial Operating Licence Board (POLB). A notice was placed in the government gazette early June 2011 indicating the intention of the department to disestablish the POLB. Public comments were invited during the June. A further notice was placed in the government gazette indicating the establishment of the PRE. The Provincial Operating Licence Board was disestablished on 30 June 2011 and the PRE was officially established on 1 July 2011. The Provincial Regulatory Entity comprises two directorates - The Operating Licences & Permits and Institutional Management directorates.
To ensure continuity of service delivery an interim adjudication committee was appointed. The members were appointed by virtue of their knowledge, expertise and experience in the field of public transport regulation.
This committee is now responsible for the adjudication of all types of applications. In future all tourism, long distance and charter applications will be dealt with by the National Public Transport Regulator (NPTR), which at this stage has not yet been established.
