Gauteng Legislature holds public hearing on Legal Practice and Judicial Matters Third Amendment Bills, 19 Feb

Bill hearing: Legal Practice Bill

The Standing Committee on Rules, led by Honourable Lindiwe Maseko will be holding a public hearing on the following Bills:

1. Legal Practice Bill

The Bill seeks to provide a legislative framework for the transformation and restructuring of the legal profession in line with constitutional imperatives in order to facilitate and enhance an independent legal profession that broadly reflects the diversity and demographics of the Republic; to provide for the establishment, powers and functions of a single South African Legal Practice Council and Provincial Councils in order to regulate the affairs of legal practitioners and to set norms and standards, amongst others.

2. Judicial Matters Third Amendment Bill

The Bill seeks to amend:

  • The Attorneys Act, 1979, in order to further regulate the powers of the board of control of the Attorneys Fidelity Fund
  • the Child Justice Act, 2008, so as to further regulate the evaluation of the criminal capacity of a child; to provide for the delegation of certain powers and assignment of certain duties by the Cabinet member responsible for social development in respect of the accreditation of diversion programmes and diversion service providers; to repeal provisions that make the Criminal Law Amendment Act, 1997, applicable to persons under the age of 18 years; and to provide for matters connected therewith.

The Bill Hearing will be attended by all Stakeholders from  the Legal Fraternity such as; Law Society of South Africa, Academic Institutions, Legal Aid- SA, Legal Resource Centre, General Bar Council, Attorneys, Attorneys Fidelity Fund Association and Department of Justice and Constitutional Development amongst others.
