Labour on South African Local Government Association notice

Labour Registrar response to SALGA notice

In response to the notice published in the Government Gazette of 15 June 2018 regarding the labour registrar's notice of intention to deregister SALGA for not complying with Sections 98, 99 and 100 of the Labour Relations Act, audited financial statements for the years ended June 2012, 2013, 2014, 2015, 2016 and 2017 were not submitted by the organisation.

A list of SALGA members and Minutes of meetings where the office bearers were elected shows that the organisation failed to keep in line with section 99 of the LRA.

In terms of section 100 of the LRA, the organisation failed to submit to the registrar their audited financial statements for the years ended June 2012 up to 2017; the names and business addresses of office bearers for the years 2011 – 2018 were also not submitted and membership figures per sector or the years ended December 2012 - 2017 were also not submitted.

Audited financial statements indicate that since 2012 – 2018 SALGA has not been complying with the sections.

The organisation was requested to submit the minutes of meetings where the elections of office bearers were held as well as an attendance register in terms of the clause 9.3.1 of the constitution.

An organisation is expected to make representations sixty days after the notice have been issued.

SALGA has since June 18 made such representation to the Registrar.
